CapT, your friend mark is a douchebag. Quake 3 is open source under the GPL. You can "license" it for FREE.meaning you can base your game off it and make money off it at no cost? p.s. the same goes for the UDK?

To use your two examples, Zuma had a lawsuit filed against it for copyright infringement of a 1998 game, and the Bejeweled gameplay originated from a 1988 game called Shariki.
Peggle is based on the Japanese 'Pachinko' machines and Plants vs. Zombies is based on the tried-and-tested tower defense gameplay. While all these games add new twists to the gameplay they borrow from, none of the fundamental gameplay elements are original.
